However, the material being ground is subject to regulation. Hemp flower is legal when it comes from industrial hemp, meaning that in the flowering or fruiting tops of the plants, from which the resin has not been removed, the sum of delta-9-THC and tetrahydrocannabinolic acid (THCA) does not exceed 0.3% when calculated on a dry weight basis, rounded to one decimal place.
This distinction has practical significance because the threshold does not apply to delta-9-THC itself, but to the sum of the two compounds, which changes the result of laboratory testing.
