
Is HHC Legal? Nine Countries and Four Mechanisms (2026)
HHC is sometimes described as a legal loophole, but in nine countries covered here, four different mechanisms catch it. We examine lists and general clauses.
HHC is sometimes described as a substance in a legal loophole. In nine countries for which we have measured status, no legal system leaves such a loophole, but each closes it differently.
Below there is no country-by-country review, because such a review explains nothing. Instead, there is a description of four mechanisms by which the law catches the same molecule, naming the countries for each.
How does the law catch a new cannabis substance at all?
Drug law has four answers to a new substance and all four are visible in this review. You can list it by name, cover it with a general clause describing the molecular structure, catch it with a provision about psychoactive effect, or list it with a reservation that shifts the boundary elsewhere.
The difference between them is practical, not theoretical. A list by name works only after adding each subsequent derivative, so the market reacts by changing the molecule. The general clause covers derivatives upfront, before anyone produces them.
The provision about effect goes even further, because it does not ask about structure at all, only about the effect on humans. However, the reservation in the entry itself can soften the whole construction, as we write about Germany.
It is worth remembering one thing before reading the rest. None of the legal systems described here leaves HHC outside the law, although the effects differ in each, and in one case mere possession is not a crime.

Which countries listed HHC by name?
The most common solution is listing by name, and five of the nine countries described here did so. However, they differ in which list HHC was placed on, which determines the effects, because the list decides the permitted use of the substance and who can legally handle it.
In the Czech Republic, for years the European base for trade in this substance, HHC now stands in the strictest local list, alongside synthetic cannabinoids. The regulation defines this list narrowly: it includes substances allowed only for limited research, scientific, and very limited therapeutic purposes.
France banned HHC as one of the first in Europe, immediately together with derivatives. The list of narcotics included hexahydrocannabinol, its acetate, and hexahydrocannabiphorol, all three in June 2023, and a year later another derivative that appeared on the market after the first ban was added.
In Slovakia, HHC is in the strictest group of the list, alongside cannabis itself, and the list names derivatives and tetrahydrocannabidiol separately. In Denmark, the substance has been controlled since May 2023, and prosecutor guidelines treat synthetic and semi-synthetic cannabinoids together with hashish, with the same 10-gram threshold.
The strictest were Italy, contrary to intuition. The decree from July 2023 placed this substance outside the cannabis category, in the table of heavy substances, so document suspension there reaches a year, not three months.
What is the general clause and why does it work better?
The general clause describes not the substance name but the molecular structure, and thus covers derivatives upfront, before they appear on the market. The best example is Switzerland, which caught HHC twice at once: once by name and once through such a clause.
By name, the substance is in the list of raw materials and products with presumed effects similar to narcotics. This is a separate category from ordinary narcotics, including substances assumed to have such effects.
The strength of this solution lies in a separate entry dedicated to cannabinoids. It covers every substance structurally derived from a specified chemical skeleton, regardless of the degree of hydrogenation of the non-aromatic ring, substituted in three indicated positions by any alkyl groups.
One phrase about the degree of hydrogenation closes the path that the market opened in other countries. A new derivative does not require addition to the list because it is covered upfront, so changing the molecule does not help.
An exception was added to the clause, which is sometimes misunderstood. The exclusion applies only to industrial and scientific uses, so private use remains under control.
What does a country do that does not list HHC at all?
The third path is not to list the substance at all, yet still ban it. This is how the United Kingdom works, which is an exception in this review: HHC does not appear by name in the drug law there, yet it is illegal to trade it.
The reason is technical and worth explaining. The local clause on cannabinoid derivatives has a narrow definition, covering tetrahydro derivatives and alkyl homologues of cannabinol, but HHC is a hexahydro derivative, so it does not fall under this definition.
We checked all four parts of the relevant annex to that law. The only name with the hexahydro element there means a different, specific compound, not HHC itself.
However, it is covered by the Psychoactive Substances Act of 2016, built on the definition of effect rather than a list of names. It suffices that the thing stimulates or suppresses the central nervous system and thereby changes the mental or emotional state of the person who takes it.
The effects here differ from those for a drug on the list, and this is the essence of this mechanism. Manufacturing and supplying, holding the substance to pass it on, and import and export are punishable, but mere possession remains unpunished everywhere except in prison.
Why does the German entry not resolve the issue?
The fourth mechanism is an entry with a reservation, best seen in Germany. Germany listed it by name in the annex to the Narcotics Act, on the list of substances allowed for trade but not prescribable by doctors, and the reservation to this entry changes its effect.
The entry itself carries two exceptions, which decide everything. The first covers cannabis intended for medical or medical-scientific purposes under a separate law and is undisputed.
The second is unusual and breaks the whole construction. The non-synthetic form in trade for non-medical purposes falls outside control, meaning the method of obtaining the substance, not its formula, decides.
We know the wording of this provision but do not know how German authorities treat commercial products made by hydrogenation of cannabidiol. Without this, it is impossible to say whether HHC from a store is legal in Germany or not.
We state this plainly instead of resolving a matter whose source does not resolve it. This is the only place in this review where the answer is “unknown,” and it is better to say so than falsely.
What does this mean for buyers and travelers?
The first conclusion is that the argument about a legal loophole does not work in any of the described countries. Even where HHC is not named, it is covered by the provision on psychoactive effect, and where it is named, it usually appears on a stricter list than buyers expect.
The second conclusion concerns changing the molecule. The market reacted to successive bans with derivatives, so countries operating with name lists had to tighten them, while those with a general clause did not have to do anything.
The third conclusion concerns Poland and is important because the national status is often described most incorrectly. HHC is neither a grey area nor a new psychoactive substance in Poland: it is a psychotropic substance and is subject to the same criminal provisions of the anti-narcotics law as other substances on the list.
We do not provide the placement of the entry in the Polish list, and this is a conscious decision. After the consolidated text from June 2024, two amendments to the same regulation came into force, and we did not interpret either, so we do not know if the entry was moved.
For travelers, the practical rule is the same as for dried cannabis. A product legally bought elsewhere does not change status when crossing the border, and the classification is decided by the list in force where you are.
What is HHC and where did it come from?
HHC is a semi-synthetic cannabinoid obtained from cannabis cannabidiol, not a compound extracted from the plant on a commercial scale. The compound itself is not new: its synthesis and ability to mimic cannabinoid effects were described eight decades ago during the search for the factor responsible for marijuana and hashish effects (Ujváry, Drug Testing and Analysis, 2024). It reached retail only in 2021.
It was preceded by two decades of turmoil in the illegal cannabinoid market, where successive cheap synthetic compounds with surprising structural diversity appeared; the novelty of recent years is semi-synthetic compounds obtained from cannabis extracts by simple chemical transformations.
The reason for this delay is economic and regulatory. After legal changes in the United States, large-scale industrial hemp cultivation started, and cannabidiol from these crops changed from a target product to a cheap substrate for further chemical transformations. This route brought delta-8-THC, delta-10-THC, and now HHC to the market (Geci et al., Cannabis and Cannabinoid Research, 2023).
The spread of this market across Europe is documented. By early 2024, HHC presence was confirmed in 24 European countries, most often as gummies and other edible products, disposable vaporizers, and flowers and resins with low THC content (Persson et al., Drug Testing and Analysis, 2025). The authors place HHC alongside the appearance of Spice-type mixtures in 2008 and call it the first major change in the cannabis substitute market since then. How is HHC made and why is it not a natural cannabinoid?
It is made in a reactor, in two stages, from plant raw material. First, cannabidiol undergoes cyclization, producing a mixture of delta-8-THC and delta-9-THC. Then this mixture undergoes catalytic hydrogenation, i.e., saturation of the double bond with hydrogen, yielding a mixture of two spatial variants of HHC (Ujváry, Drug Testing and Analysis, 2024). The name hexahydro refers to saturation of the structure, not the number of components in the preparation.
This is why the term natural is misleading here. Cannabidiol, cannabigerol, and cannabinol are produced in the plant with enzyme involvement, in a spatially strictly defined way. HHC results from a chemical transformation lacking such selectivity, producing a mixture of molecular variants. Work on obtaining an active variant dominance was described only by a group from Modena in 2023 (Russo et al., Scientific Reports, 2023). The same work calls it plainly: semi-synthetic cannabidiol derivatives are added to cannabis products to circumvent legal restrictions.
A separate issue is that cannabidiol can transform into psychoactive compounds outside the reactor. A review of data in this area indicates that in acidic environments cannabidiol decomposes into psychoactive products, but most studies do not confirm such transformation in the human body. The authors conclude about storage stability of preparations, not their effects (Golombek et al., Toxics, 2020).
How do 9R and 9S epimers differ and how strongly do they activate the CB1 receptor?
They differ in the arrangement of one group in the molecule, resulting in different potency. Hydrogenation yields a mixture of variants labeled 9R and 9S. Preclinical studies indicate that the 9R variant has properties similar to THC (Ujváry, Drug Testing and Analysis, 2024). The proportion of both variants depends on synthesis conditions, so two products with the same declared HHC content may act differently.
The potency was measured in laboratory conditions on cells with the human CB1 receptor. Both HHC variants and their derivatives were tested for potency and efficacy in receptor activation, using the synthetic cannabinoid JWH-018 known from Spice mixtures as a reference (Persson et al., Drug Testing and Analysis, 2025).
The authors draw two conclusions. First, the tested compounds mimic cannabinoids, except for acetates. Second, acetates probably act as precursors, i.e., substances converted in the body to the active form, making it difficult to predict the effect from laboratory tests alone.
The table shows the discrepancy most important for buyers. The potency of individual variants differs many times, yet the list covers them together because it does not distinguish epimers at all.

Is HHC legal in Poland?
No. HHC has been a controlled substance in Poland continuously since 2023. It was added to the list maintained by the Minister of Health together with HHC-O by the regulation of April 17, 2023, effective May 5, 2023 (Dz.U. 2023 poz. 744).
The Minister of Health regulation of July 7, 2026, effective July 28, 2026, changed the placement of HHC in this list (Dz.U. 2026 poz. 934). This is a move within the list, not a removal of control.
This must be said plainly because Polish texts about HHC circulate the signature Dz.U. 2023 poz. 1232 as the basis for the ban. That signature belongs to the Ministry of National Defense regulation on foreign trips of professional soldiers. We checked this in the ELI register and provide it here because a wrong signature in legal texts is more dangerous than none: it looks like evidence.
The scope of control also covers derivatives. HHC-O has been on the list since the same day as HHC. Hexahydrocannabiphorol, known on the market as HHC-P, was added to the list of new psychoactive substances by the regulation effective May 22, 2025 (Dz.U. 2025 poz. 598), together with delta-9-tetrahydrocannabiphorol. The legal status described in this article was established as of August 10, 2026, based on the content of acts read in the ELI register, not secondary sources.
It is worth knowing where the rhythm of these changes comes from. The July 2026 regulation implements the European Commission delegated directive of October 14, 2025, amending the annex to the Council framework decision on including new psychoactive substances in the drug definition, and was notified to the Commission earlier. The national list keeps pace with EU findings and changes several times a year. The practical conclusion for the reader is simple: the date next to the statement about legality is as important as the statement itself, and a text from two years ago may describe a state that no longer exists.
What are the penalties for possession and sale of HHC?
Criminal liability under the anti-narcotics law, with severity depending on the act and quantity. Possession of narcotics or psychotropic substances contrary to the law is punishable by imprisonment up to 3 years, and for a significant amount from 1 to 10 years.
A lesser offense has a separate, milder range: a fine, restriction of liberty, or up to one year imprisonment (art. 62 of the law, consolidated text Dz.U. 2023 poz. 1939).
The law provides one relief valve. If the act involves a small amount intended for personal use, proceedings may be discontinued before investigation or inquiry if punishing the perpetrator would be pointless due to circumstances and social harm degree (art. 62a). This is a possibility, not a guarantee, assessed by prosecutor or court.
Trade is treated more severely. Introducing narcotics, psychotropic substances, or new psychoactive substances into circulation contrary to the law is punishable by a fine and imprisonment from 6 months to 8 years, and for a significant amount from 2 to 12 years (art. 56). Manufacturing, processing, or altering is punishable by up to 3 years, and if concerning a significant amount or done for financial gain, by imprisonment not less than 3 years (art. 53). The purchase date does not affect possession assessment after the ban comes into force.
Do THC tests detect HHC?
Partially and not all. The same team that developed a method for detecting both HHC variants in blood tested cross-reactivity of six compounds in five immunological screening tests for serum, urine, and saliva. Urine strip tests and ELISA serum tests proved useful for detecting HHC, while saliva tests performed worse in this comparison.
HHC analogues and hydrogenated cannabidiol showed no cross-reactivity in any tested tests (Höfert et al., Drug Testing and Analysis, 2024). We write separately about hydrogenated cannabidiol in the article on H4CBD.
The same work provides first data on the scale of the phenomenon in road traffic. Among 321 serum and plasma samples collected during road checks in western Saxony from drivers suspected of cannabis use, both HHC variants were detected in 17 samples, i.e., 5.3 percent. This percentage concerns a group already selected by suspicion, not all drivers. The average 9R to 9S ratio was 1.99, and concentrations reached 35.35 nanograms per milliliter for 9R.
HHC metabolism in humans differs from THC metabolism. In a study with two volunteers who took HHC by inhalation and orally, main metabolites detected in urine differed from main delta-9-THC metabolites. The 9S variant appeared in urine after both administration routes, while the more psychoactive 9R variant only after inhalation (Schirmer et al., European Journal of Mass Spectrometry, 2023). The practical conclusion is inconvenient for both sides: a negative screening test does not prove the person did not take HHC. A 2024 literature review notes the lack of rapid immunochemical methods for detecting HHC and its metabolites in urine, so detectability today depends on the test used by a particular lab, not on substance properties.
What is known about HHC safety in humans?
Much less than the product’s presence on the market suggests. A review summarizing HHC chemistry, analytics, and pharmacology states plainly that human pharmacology, including metabolism, awaits study, and animal metabolism is partially known (Ujváry, Drug Testing and Analysis, 2024). This sentence comes from a literature review, not vendor material.
The second unknown concerns how often HHC is analyzed at all. The Modena group notes that knowledge about HHC, its pharmacological properties, and prevalence is limited because routine toxicological analyses usually do not include it (Russo et al., Scientific Reports, 2023). The substance may be present in a sample and remain unreported.
What this means for risk assessment. The 9R variant activates the CB1 receptor as a partial agonist, the same mechanism by which THC causes short-term memory impairment, reaction time prolongation, coordination disorders, and increased heart rate. The difference is that THC has dozens of human studies, while HHC has almost none. This is not an argument for safety but a description of a gap: a psychoactive substance entered the market before its effects were studied.
Laboratory study authors say this plainly. Data on semi-synthetic cannabinoids’ pharmacology are needed to understand their effects, assess health risks, and plan public health responses, and available data are sparse (Persson et al., Drug Testing and Analysis, 2025). Their own study concerned cultured cells, not humans, and this limitation cannot be bypassed by interpretation.
What are HHC-O and HHC-P and are they more risky?
They are HHC derivatives that appeared on the market after it and have a different action profile. HHC-O is HHC acetate, a molecule with an attached acetate group. HHC-P, i.e., hexahydrocannabiphorol, has an extended side chain. Both substances are listed alongside HHC as further semi-synthetic cannabinoids appearing on the cannabis substitute market (Persson et al., Drug Testing and Analysis, 2025).
Studies on cells with the human CB1 receptor showed that the active HHC-P variant stimulates the receptor more strongly than the active HHC variant: its potency was twice lower than JWH-018, while for HHC it was five times lower. Acetates behaved differently than both compounds. The active HHC-O variant stimulated the receptor to an even lesser extent, and the 9S variant did not stimulate it at all, which authors explain by acetates probably acting as precursors converted only in the body.
From the user’s point of view, this means the worst possible arrangement. The preparation may contain a compound stronger than HHC or one whose effects cannot be predicted from lab tests, while the label uses a letter abbreviation. In Poland, HHC-O has been on the list since May 5, 2023, and HHC-P since May 22, 2025, so neither derivative is a legal HHC substitute; both are discussed separately in the guide to semi-synthetic HHC derivatives. The sequence of events well illustrates the whole market mechanism: a derivative appears in sales, is listed, and its place is taken by the next molecule with even less documentation.
Does HHC get into products described as cannabis?
Yes, and this is the main reason the topic concerns also people who do not seek HHC. The Modena group describes the mechanism bluntly: to circumvent legal restrictions, semi-synthetic cannabidiol derivatives causing effects similar to delta-9-THC are added to cannabis products, which are sold openly in stores and online (Russo et al., Scientific Reports, 2023).
The forms in which HHC was found in Europe are exactly the same as those in which fiber hemp products are sold: gummies and other edible products, disposable vaporizers, and flowers and resins with low THC content. Buyers cannot distinguish them by appearance or smell, and the packaging description is often the only source of composition information.
This is why analytical methods matter. The mentioned Modena work used a rapid chromatographic method with UV detector and high-resolution mass spectrometer, allowing determination of up to ten main phytocannabinoids and both HHC variants simultaneously in commercial cannabis samples. Before such methods were used, HHC presence in a sample could simply be overlooked.
For Polish readers, the consequence is primarily legal. Possession of a controlled substance is a crime regardless of whether the buyer knew what the product contained. Risk is reduced by buying from sources presenting batch testing by external labs and avoiding products labeled with letter abbreviations whose meaning the seller cannot explain.
Why does the composition of products with HHC remain unknown?
Because chemical transformations conducted outside pharmaceutical supervision yield not one compound but a mixture. A review devoted to delta-8-THC products from cannabis cannabidiol describes this phenomenon most precisely: the authors compiled documented by-products of acidic cannabidiol cyclization and emphasize that except for delta-8-THC itself, compounds present in these mixtures have not undergone any toxicological evaluation in humans (Geci et al., Cannabis and Cannabinoid Research, 2023).
The same work assesses quality control in this emerging branch as completely insufficient and links it to a separate health problem: vaping products with uncertain composition fit into a wave of lung injuries associated with e-cigarettes, with mortality approaching 2 percent in California. The first stage of HHC synthesis is the same stage described in this review.
The third element is the document with which the seller reassures the buyer. A certificate of analysis attached to a grey market product has no verifiable value: it cannot be checked whether it comes from testing that batch or whether the lab even exists. The method for determining both HHC variants alongside main phytocannabinoids, described in the previous section, was developed in a scientific center and is not available to consumers.
The authors of the delta-8-THC review say they probably compiled the first complete list of documented by-products of this transformation and summarize the situation in one sentence: consumers take products labeled inconsistently with composition, containing compounds never tested for toxicity. The label in this market branch is thus not information about composition but a sales element.
What is known about cannabinoids from fiber hemp?
Only that they are not controlled and that data about them come from different types of studies. The Minister of Health lists name substances, and neither cannabidiol nor cannabigerol appear there even once, so neither is a controlled substance in Poland.
Fiber hemp are plants in which the sum of delta-9-THC and tetrahydrocannabinolic acid content in flowering or fruiting tops does not exceed 0.3 percent dry weight, rounded to one decimal place (art. 4 point 5 of the anti-narcotics law).
Knowledge about cannabigerol is so far mainly based on user reports. The first survey among people using preparations with predominance of this cannabinoid included 127 participants. The most frequently mentioned reasons for use were anxiety (51.2 percent), chronic pain (40.9 percent), depression (33.1 percent), and insomnia and sleep disorders (30.7 percent). Forty-four percent reported no adverse effects, and among reported ones, dry mouth (16.5 percent) and drowsiness (15 percent) dominated. Withdrawal symptoms were not reported by 84.3 percent (Russo et al., Cannabis and Cannabinoid Research, 2022). The authors conclude that preparations with cannabigerol predominance should be tested in randomized trials because they have not been so far.
Cannabidiol has better documentation but is not neutral. A clinical data review lists fatigue, diarrhea, and changes in appetite and body weight as the most common adverse effects (Iffland and Grotenhermen, Cannabis and Cannabinoid Research, 2017), and the EFSA panel states that cannabidiol safety cannot be established for people under 25, pregnant and breastfeeding women, and people taking medications (EFSA Panel NDA, EFSA Journal, 2026). Legality is thus not the same as health neutrality. Hemp oils are collected in the oils category, and legal vaporizer raw material in the dried cannabis category.
What to do if someone took HHC and feels bad?
For acute symptoms, call for help rather than wait for them to pass. Strong heart rate increase, chest pain, shortness of breath, anxiety attack with loss of contact with surroundings, or fainting are reasons to call 112 or go to the emergency room. Medical staff should be given the name of the substance taken, the form in which it was taken, and the time of intake.
Information about the substance itself is diagnostically important because, as described above, routine screening tests may not detect HHC, and HHC metabolites differ from THC metabolites. Hiding this information from the doctor does not protect the patient but hinders diagnosis.
For milder symptoms, usually a calm, quiet environment, hydration, and presence of another person suffice. Do not combine psychoactive substances with alcohol or sedatives because their central nervous system depressant effects add up. After the incident, it is worth consulting a family doctor or addiction specialist. Data on how HHC behaves in humans are so sparse that no symptom list from this article should be treated as exhaustive. Driving is a separate matter. Since the 9R variant activates the CB1 receptor like THC, impaired driving ability must be assumed, and blood tests of drivers in Saxony show HHC actually appears in road check samples.
