Marijuana in Montenegro: what is allowed and what are the risks (2026)

In Montenegro, possession for personal use is an offense with a fine from 100 to 2000 euros, and prescription medication has its own transport procedure. We examine both laws.

Montenegro divides responsibility between two laws, and this division is the most important here. The criminal code deals with sales, while possession for personal use is governed by a separate law on preventing drug abuse.

For travelers with a prescription, Montenegro has one of the most specific procedures in this entire overview. Below is what follows from the texts of both acts.

Is possession of marijuana in Montenegro punishable?

It is prohibited, but not by the criminal code, only by the law on preventing drug abuse, and this is a difference that is easy to overlook when reading popular summaries. The criminal code describes acts related to sales, and the boundary between the two laws runs through the purpose of the act, not its weight.

The code punishes the production, processing, sale, offering for sale, as well as buying, storing, and transferring for sale, as well as mediating and introducing into circulation. All these activities are connected by a commercial purpose.

Possession for personal use does not fit into this description, as it lacks that purpose. It is addressed by a separate provision of the law, which prohibits the use, production, trade, and possession of drugs for personal use, as well as the cultivation of plants suitable for their production.

The prohibition applies outside the conditions provided for in the law itself, so it is not absolute. Exceptions mainly concern medications containing narcotics, which we discuss in the section on the medical program.

How much marijuana is allowed in Montenegro?

The law does not recognize a quantity threshold for possession for personal use, as possession as such is prohibited. The legislator did not use weight, number of pieces, or active substance content here, so there is no size below which the act ceases to be an offense.

The only amount that Montenegrin law directly indicates is the amount of medication containing narcotics for personal therapy. The provision states that a person may possess it in the amount determined by the doctor, thus transferring the decision to the office.

Exceeding this amount is a separate offense. The structure is such that the boundary is set by the medical document, not by a statutory table, which distinguishes Montenegro from most countries in this overview.

When crossing the border, the limit becomes temporary. The law allows for a supply for no more than thirty days, which we discuss in more detail in the section on transporting medication.

The practical conclusion is twofold. For over-the-counter narcotics, there is no permissible amount, and for prescription medication, there is one, but it is determined by the doctor.

It is worth comparing this with neighboring countries that operate with the concept of a smaller amount. Montenegro does not have such a category at all, so a minor act has nowhere to fall.

What are the consequences of exceeding the threshold in Montenegro?

For possession of narcotics for personal use contrary to the law, a natural person faces a fine from 100 to 2000 euros, and this is considered an offense, not a crime. This is the lowest level of responsibility in the entire Montenegrin system, and the difference from the next level is the most significant in this country.

This same range covers three other acts. These are possession of medication with narcotics for personal therapy in an amount greater than that specified by the doctor, issuing such medication to a person under 18 years old, and exposing another person to narcotics outside of prescribed treatment.

A completely different level begins with sales. The criminal code provides for imprisonment from two to ten years, from two to twelve for importing into Montenegro for sale, and from three to fifteen in the most serious cases.

This highest range includes organizing a network of sellers and selling to a child, a mentally ill person, a person treated for addiction, in an educational institution or nearby, in a correctional facility, in a public place, or at a public event.

The code also adds a vent known from several other countries in the region. An offender who reveals from whom they acquired the narcotic may be exempted from punishment. The narcotics and means for their production are subject to confiscation and destruction.

Does Montenegro have a medical marijuana program?

The law does not create a cannabis program, only a general principle covering all medications containing narcotics. A person may possess such medication for personal therapy in the amount determined by the attending physician, and exceeding this amount is a separate offense, punishable by exactly the same fine as possession of narcotics without a prescription.

Issuing such medications to persons under 18 years old is prohibited. This is a subjective restriction, independent of medical indication and who issued the prescription.

The law separately regulates an atypical situation worth noting. Ships and aircraft in international traffic may possess narcotics for providing first aid, in amounts necessary for that purpose, after prior permission from the agency.

We did not check specific cannabis preparations allowed in Montenegro. This material describes the statutory framework, not a list of medications currently available in local pharmacies.

For a patient from Poland, the procedure for transporting their own medication across the border is more important. Montenegro has described it in detail, and it is one of the few countries in this overview that has done so so specifically.

It is worth separating two things that can easily be confused here. The law speaks of medications containing narcotics as a category, not of cannabis preparations as a separate type of therapy.

Is it allowed to cultivate hemp for personal use in Montenegro?

Cultivation is prohibited outside the conditions of the law, and the obligation to clean up also falls on the landowner, which is a rare solution in this overview. The provision prohibits the cultivation of all plants that can be used for the production of narcotics and does not name any species.

A separate offense for a natural person, punishable by a fine from 100 to 2000 euros, is the failure to destroy self-sown plants suitable for the production of narcotics by the owner or user of the land. Responsibility arises from inaction, not from action.

This same provision covers the cultivation of poppy or hemp without permission and without a purchase agreement for the entire harvest with an entity registered for trade. Legal cultivation thus requires two documents at once, not just one.

It is also an offense not to transfer the entire harvest within four months of harvesting. The legislator thus closed the path where permission and agreement exist, but the yield remains in place.

The last act on this list is the failure to report to the police circumstances indicating suspicion of unauthorized use of poppy or hemp. This is an informational obligation that is simply not present in most countries in this overview.

All these acts are offenses, not crimes. Criminal responsibility is only triggered by the purpose of sale, described in the criminal code.

Can cannabis medication be imported into Montenegro?

Montenegro has a clear and quantifiable procedure for travelers with medication, which is rare in this overview. A person crossing the border may possess medication containing narcotics in the amount needed for personal therapy, for a period of no more than thirty days, counting from the day of crossing the border.

The basis is a certificate from the chosen doctor or a specialist in the field of mental health. The document must therefore come from a specific person conducting the treatment, not from any facility.

Similarly, it is allowed to bring medication for an animal traveling with the owner, based on a certificate from a veterinarian. The legislator has thus also thought of a situation that most regulations in this overview overlook.

The certificate cannot be older than 90 days, and when crossing the border, it must be reported to the customs authority. Both of these conditions are as important as the document itself, as failure to meet them incurs liability.

Failure to report the veterinary certificate is a separate offense punishable by a fine of 100 euros. This clearly shows that reporting is not a formality, but an obligation with its own sanction.

The amount is counted in days of therapy, not in grams or packages. This is important because it allows determining the permissible supply regardless of the form of the medication.
