The last of these acts is the most important for travelers. The same amount that is an offense within the country becomes a crime when transported across the border, regardless of whether it was intended for anyone else.

How much marijuana is allowed in Estonia?

Estonian law operates with the concepts of small amount and large amount, but there are no numbers in the read provisions. It is these two concepts that separate an offense from a crime and a lesser crime from a more serious one, and the provision does not refer to any weight table or executive act.

The scale increases in two independent steps. The first depends on intent, the second on the amount itself, and both can act simultaneously, which immediately moves the case to the highest brackets provided in the code.

The lack of a number means that the assessment is up to the authority conducting the case. In practice, the circumstances decide: the method of storage, division into portions, and everything that indicates a purpose other than personal use.

And again, the caveat about the text version applies. The read translations are historical, so the brackets mentioned above require confirmation in the wording currently in force.

It is worth comparing this structure with neighboring Lithuania, which operates similarly. There, too, the code operates with descriptive sizes, and specific values are established by an executive act, so the criminal text speaks only about the consequences of each category.

For travelers, the conclusion is practical and inconvenient at the same time. It is impossible to check before departure where the Estonian border runs, because the number is not in the act to which the studies refer.

What are the consequences of exceeding the threshold in Estonia?

For an offense, that is, using without a prescription or possessing a small amount, a fine of up to 300 units of fine or arrest is imposed. A legal entity pays up to 3200 euros in this mode, which shows that the provision also covers economic entities, not just individuals.

The proceedings are conducted extrajudicially by two authorities: the Police and Border Guard Board and the Tax and Customs Board. The substance is subject to confiscation ordered by these authorities or by a court, depending on the procedure.

For the crime of distributing small amounts, a monetary penalty or up to three years of imprisonment is imposed. If the act was committed in a group or in case of recidivism, the range reaches five years.

For distributing large amounts, a penalty of one to ten years is provided, and in a group or in case of recidivism, from three to fifteen years. This is already a level comparable to the strictest European countries in this comparison.

It is worth noting the extrajudicial procedure for the offense. The case ends with a decision of the authority, not a judgment, which shortens the proceedings, but does not change the fact that the substance is confiscated.

Does Estonia have a medical marijuana program?

No national patient access pathway has been established, and we state this directly instead of filling the gap with secondary studies. The Estonian Medicines Agency and the police portal refuse access to machines, and the read drug law regulates distribution and responsibility, not the rules for issuing prescriptions. However, one signal can be read from the criminal provision itself. Since using a narcotic substance without a prescription is an offense, a prescription for such a substance is possible in Estonia, although the conditions for its issuance are not described in this material.

Separately from national law, one EU authorization operates, and it also applies here. The drug containing cannabidiol has a centrally issued marketing authorization from September 2019, valid throughout the Union, with orphan drug status.

The indication is for the adjunctive treatment of seizures in Lennox-Gastaut syndrome and Dravet syndrome, together with clobazam, in patients from the age of two. It also includes tuberous sclerosis, with other antiepileptic drugs, from the same age.
