Marijuana in Hungary: what is allowed and what are the risks (2026)

Hungary is a country where the threshold is counted differently than anywhere else. It does not weigh the bag, but the content of the active substance, and in both its forms at once.

There is also a mechanism here that can completely waive the penalty upon first contact with the law. Below is what follows from the text of the Hungarian Penal Code and from the website of the local pharmaceutical institute.

Is possession of marijuana in Hungary punishable?

Yes, and more severely than one might expect from the country’s reputation. Paragraph 178 section 1 places cultivation, production, acquisition, possession, import, export, and transit of drugs in the same category and provides for penalties of 1 to 5 years of imprisonment, without differentiating between substances.

Reliefs begin only two sections lower. With an insignificant amount, the act from section one becomes a misdemeanor punishable by up to two years, which means it drops a whole level, but it still remains a punishable act.

A separate section six covers the consumer. Anyone who uses a drug or acquires or possesses an insignificant amount for personal use is subject to a penalty of up to two years, unless a more serious crime has occurred. This is a separate type of act, designed for the user, not the dealer.

It is stricter near children, and it is worth knowing this before traveling. An adult who cultivates, produces, acquires, or possesses a drug with the involvement of a minor or on the premises of an educational, upbringing, or childcare facility is liable for a penalty ranging from two to eight years.

How much marijuana is allowed in Hungary?

Hungary has numbers, and they are unusually precise. The insignificant amount for THC is a content not exceeding six grams, with the law counting the so-called total-THC, which is THC in both neutral and acidic forms combined. For the plants themselves, the insignificant amount is at most five specimens.

The difference from most European thresholds is fundamental. It does not weigh the material, but the active substance contained in it, so six grams of THC is significantly more than six grams of dried material. The result depends on laboratory analysis, not on the weight indication.

These two values are the basis for all others. A significant amount is exceeding twenty times the upper limit of the insignificant amount, and a particularly significant amount is two hundred times the same limit.

In practice, this gives 120 grams of total-THC or one hundred plants for a significant amount and 1200 grams or one thousand plants for a particularly significant amount. The entire scale is thus built from one number and two multipliers.

For comparison, it is worth looking at the rest of the list. Cocaine has 2 grams, heroin 0.6 grams, and amphetamine 0.5 grams, so cannabis has been treated the most leniently on the entire list, and by a very large margin.

What are the consequences of exceeding the threshold in Hungary?

The scale is wide and starts high. In the basic type, it threatens from one to five years, with an insignificant amount and with mere use up to two years, and with profit-making activity, in a criminal agreement, or using a public function from two to eight years of imprisonment.

It is even harsher higher up. A significant amount is from five to ten years, and a particularly significant amount is from five to fifteen. Mere preparation for the act is punishable by up to three years, so liability begins before possession itself.

However, the most important is paragraph 180, which is the Hungarian elterelés. No penalty applies to anyone who cultivates, produces, acquires, or possesses an insignificant amount for personal use or uses a drug if they confess to the act and demonstrate participation in a program.

The condition is specific and requires documentation. To issue a first-instance judgment, it must be shown that for at least six months, continuous treatment for addiction, other care for drug users, or preventive-informational services were utilized.

This path can be closed. It will not open if, within two years before the act, the prosecution against the perpetrator was already deferred or the proceedings were suspended for the same reason, or if their responsibility for drug trafficking or possession was established.

Is there a medical marijuana program in Hungary?

There is no separate cannabis program in the sources used, and access to the preparation without Hungarian marketing authorization leads through the general path of individual demand for the drug. The application is submitted by the attending physician or a specialist to the national office, on an official form.

The application must include detailed documentation of the illness not older than six months. The drug can then be used only for the indications and circumstances specified in the product characteristics, and not for any condition indicated by the doctor.

The deadlines are short. The office has eight calendar days from the receipt of the application, and in case of urgent need, no later than three days. This is clearly faster than in many programs based on a separate cannabis path.

The form of resolution depends on the origin of the preparation. If it comes from the European Economic Area, the office issues a statement on the validity of the application. If from outside this area, after examining the necessity, it issues a permit. The document goes to the doctor, who then hands it over to the patient.

One caveat is more important than the rest. The lack of a separate program is a conclusion from the silence of the sources, not a statement from the office: the Hungarian official legal database is closed to machines, so it could not be confirmed with the publisher.

Is it allowed to cultivate hemp for personal use in Hungary?

Cultivation does not have a separate, milder provision in Hungary. It stands in paragraph 178 section 1 together with possession and import, with the same range of 1 to 5 years, so it is formally treated the same as smuggling a drug into the country. The same range thus includes a pot in an apartment and smuggling across the border.

Relief, however, goes through quantity. Up to five plants is an insignificant amount, so the act drops to a misdemeanor punishable by up to two years, exactly the same as possessing six grams of THC.

In the case of cultivation for personal use, an additional path to non-punishment opens up from paragraph 180. It requires a confession to the act and six months of treatment or a preventive-informational program, documented before the first-instance judgment.

This solution is worth comparing with countries that have given cultivation its own, milder provision. Hungary has taken a different path: the provision remains strict, and the relief comes through the quantitative threshold and the perpetrator’s behavior after the act.

The practical conclusion is that the number of plants is decisive here. The fifth plant and the sixth are two different legal qualifications, even though the difference in the garden seems insignificant.
